16) On-Line Donations In order to make donations online, you must submit the necessary contact and payment information, including, without limitation, your name, address, credit card and email. You are responsible for the accuracy of the information in your account(s) supplied by you to Más Wired. By providing such information to Más Wired by any means (e.g.: email, fax, telephone, mail, etc.), you represent that any information or materials provided by you shall be accurate, complete and correct and that you shall have lawful right to provide such information to Más Wired for use in processing or receiving your donations from the Site. In order to make donations online using the payment method displayed on the Web site (e.g., VISA, Mastercard, PayPals, etc.), you must be 18 years of age or over. By using the Site’s payment method, you confirm that you possess the legal authority to enter into the conditions of use for the Site, including, without limitation, instructing Más Wired or its authorized vendors to collect any payments from a credit or debit card, and to use the Site in accordance with all terms and conditions of these Terms. Billing to your credit card or to your account occurs at the time of purchase or donation or shortly thereafter. You agree that you are responsible for all charges incurred by your use of the Site and you expressly authorize Más Wired to charge the credit card provided by you or listed on your account for any donations submitted online via the Sites. You waive any rights that you may have to revoke or reject the charges for any donation under your agreement with the bank, financial institution or credit card processor.
17) Miscellaneous
These Terms set forth the entire understanding and agreement between you and Más Wired with respect to the subject matter hereof. The language in this Agreement shall be interpreted as to its fair meaning and not strictly for or against any party. Any rule of construction to the effect that ambiguities are to be resolved against the drafting party shall not apply in interpreting this Agreement. This Agreement may be automatically assigned by us in our sole discretion to a third party in the event of an acquisition, sale or merger. If any provision of the Terms is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of the Terms shall remain in full force and effect. Headings are for reference only and in no way define, limit, construe or describe the scope or extent of such section. Más Wired’s failure to act with respect to any failure by you or others to comply with these Terms does not waive its right to act with respect to subsequent or similar failures. You may not assign or transfer your rights or obligations under these Terms without the prior written consent of Más Wired, and any assignment or transfer in violation of this provision shall be null and void. There are no third party beneficiaries to these Terms.
